A Sydney council has thwarted attempts for an Indigenous land grab of prime beachfront real estate worth at least $100 million but more than 40,000 land requests are still pending across Australia.

Mosman Council voted against the request, known as an Aboriginal Land Claim, after the debating the matter in a closed meeting session on Tuesday night.

The 2,500 square metre waterfront block, called Lawry Plunkett Reserve, is located behind the Esplanade on Balmoral Beach.

Real estate agents have estimated the value of the reserve could be worth at least $100 million, as reported by Sydney’s 2GB radio.

The original claim made by Sydney’s Metropolitan Local Aboriginal Land Council was lodged more than a decade ago, but has only just gone through the assessment phase.

Lawry Plunkett Reserve is known for its bushland walking tracks through to the scenic beach front, and is used as a recreational space by Sydneysiders.

It sits between Botanic Road and Plunkett Road, opposite The Boathouse restaurant.

Speaking to Sky News Australia on Wednesday morning, Mosman Councillor Roy Bendall detailed how the council came to know about the land claim.

“These matters are assessed by Crown Lands… We found out just recently that there was a claim lodged in 2009,” he told host Laura Jayes on AM Agenda.

“Now, we didn’t become aware of it until we were asked by Crown Lands to put in a reason why these matters shouldn’t be granted.

“I personally find the whole thing quite astounding that the local governments and people controlling Crown Lands, or managing Crown Lands, aren’t informed when these claims were originally lodged. ”

Mr Bendall outlined the next stages in the process of the claim for the land, which he said the council has been looking after for a century.

“Council voted last night to put their objections into this claim because we’ve been maintaining this land for 100 years,” he said.

“We’ve got bushland groups who volunteer, in fact they were up there speaking last night saying how can this land be claimed, it’s not supposed to be claimable if it’s an active part of our area.”

He said the original application for the block was made under the Aboriginal Land Rights Act 1983.

The Act allows Local Aboriginal Councils to claim unused or unoccupied land owned and managed by the state government, also known as “Crown Land”.

Successful requests for land are then transferred in “freehold title” to the claimant, as stated on the NSW government’s Aboriginal Affairs website.

“Originally we were asked to keep it confidential,” Mr Bendall said.

“But you can’t keep these matters confidential because I mean you’re affecting millions of people who utilise the beach and the neighbours and our expenditure alone on maintaining that site for the last 100 years.

“It should come to council and this should be in the public domain.”

It comes after Metropolitan Local Aboriginal Land Council CEO Nathan Moran revealed on 2GB radio on Wednesday there are currently 40,000 active land claims in New South Wales.

He told host Ben Fordham there are between 2,500 to 3,000 claims from just his group alone.

“We’ve made the claims, we just hope they can be assessed and to acknowledge that on evidence of success rates, not all claims are actually made successful and granted to us,” he said.

In a statement to SkyNews.com.au, a Mosman Council spokesperson said councillors unanimously voted to oppose the land claim for Lawry Plunkett Reserve.

The council also concluded to give evidence to the Aboriginal Land Claim Assessment Team to show the reserve is being used by the public and should not be considered “claimable land”.

“After lengthy debate and representations from local residents the Council unanimously resolved that, as representative of the Mosman community, it object to the land claim and provide evidence to the Aboriginal Land Claim Assessment Team (ALCAT) that the land has been lawfully used and is required for essential public purposes, and therefore should in no way be considered claimable land,” a spokesperson said.

“A formal submission will be made to the ALCAT in this respect and Council will also seek details of any other Aboriginal Land Claims in Mosman.”

The land claim was discussed in a closed session during the council meeting on Tuesday, as recommended by the governance manager.

“This matter considers information concerning the nature and location of a place or an item of Aboriginal significance on community land,” Tuesday’s meeting agenda stated.

“It is recommended that it be dealt with in closed session in the Confidential Reports section of the general order of business and Council resolve accordingly.”
