The Supreme Court of Japan has declared a Trade Ministry policy that limited a transgender official’s access to women’s restrooms as illegal, following a years-long legal battle. The court unanimously ruled against the policy, overturning a lower court’s decision in favor of the official. The court stated that the policy lacked validity as it excessively considered the concerns of the official’s colleagues without taking into account her personal circumstances.
The transgender official, who remains unnamed, filed a lawsuit against the government in 2015 after being restricted to using women’s bathrooms located no more than two floors away from her workplace. The Trade Ministry justified this restriction by claiming it was to accommodate other female workers. However, the official argued that the limitations were discriminatory.
In 2019, the Tokyo District Court sided with the plaintiff and ordered the government to pay 1.32 million yen ($9,400) in damages. However, this ruling was overturned on appeal in 2021. The appellate judge believed that the bathroom restrictions were lawful and intended to create an appropriate workplace environment by considering the sexual concerns of other employees.
Tuesday’s decision by the Supreme Court reversed the previous ruling and deemed the bathroom policy illegal. However, Judge Yukihiko Imasaki clarified that the court’s opinion did not apply to public restrooms in general and that this specific issue would need to be settled in a separate case.
The transgender official, who has been diagnosed with gender dysphoria but has not undergone gender reassignment surgery, expressed her satisfaction with the ruling during a press conference. She expressed hope that the decision would be applied to other cases involving discrimination. She emphasized the need for society to seriously consider how to engage with minority groups, such as people with disabilities and the LGBTQ+ community.
The Trade Ministry has stated that it will review the ruling and determine how to respond after engaging in dialogues with other government agencies.
Until recently, Japan had no laws prohibiting discrimination against LGBTQ+ individuals. However, in June, lawmakers passed legislation aimed at promoting understanding of gay and transgender people and prohibiting unfair discrimination. Despite this progress, Japan remains the only G7 nation that does not legally recognize same-sex marriages. Some local courts have deemed this policy unconstitutional, but only a ruling by the Supreme Court can change the legal status of gay marriage in the country.
